ENTIRE AGREEMENT: This Agreement contains the entire understanding by and between Brianna Niebling T/A “Photos By Bri”, hereinafter referred to as “PHOTOS BY BRI” and the CLIENT, hereinafter referred to as “The CLIENT” regarding the subject matter hereof. It supersedes all prior and simultaneous agreements between the parties. CONFIRMATION/ RESERVATION: A signed contract and deposit are required to reserve the date and time of the session. If the session is rescheduled, postponed, or cancelled for whatever reason, or if there is a breach of contract by the CLIENT, the deposit is non-refundable and will be considered as liquidated damages to PHOTOS BY BRI. In the case the session is rescheduled or postponed, PHOTOS BY BRI will do their best to accommodate, but there is no guarantee they will be available. COOPERATION: The CLIENT and PHOTOS BY BRI consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. Unless otherwise noted, PHOTOS BY BRI, it's associates or employees will be the exclusive photographer(s) at this session. CLIENTS must also notify PHOTOS BY BRI in writing if they wish to have anything photographed in a particular way, and will not be held accountable for not photographing desired images if it is not notified, or revealed on the day. RESPONSIBILITIES: PHOTOS BY BRI is not responsible for compromised coverage due to causes beyond their control including but not limited to lateness of the CLIENT, if individuals fail to appear or cooperate during the session, weather conditions, incorrect addresses provided to the photographer, and restrictions of the locations. Children under 18 years of age are to be supervised by their parents and are not the responsibility of the photographer. The Photographer cannot be held responsible for damage to garments due to environmental events. HOUSE RULES: CLIENTS agree and understand that the photographer(s) are limited by the guidelines of the location site/venue management/government rules and CLIENTS agree to accept the results that may occur from said guidelines. Negotiation with the officials/management for moderation of guidelines is solely the CLIENTS responsibility. EXPENSES: Travel expenses such as parking, shipping, or destination fees must be reimbursed to the Photographer and will be added to the balance due after the event. Travel fees are pre-determined and will be set out in the initial payment total. Clients are responsible for all location fees and permits. PERMITS: The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which PHOTOS BY BRI will be performing services. SAFETY: PHOTOS BY BRI reserves the right to terminate coverage and leave the location of the session if the photographer experiences inappropriate, threatening, hostile or offensive behavior from person(s) at the location; or in the event that the safety of the photographer(s) is in question. If the CLIENT appears under the influence of alcohol or drugs during the shoot, PHOTOS BY BRI has the right to cancel the shoot immediately due to liability and health concerns arising. POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of PHOTOS BY BRI. PHOTOS BY BRI’s edited images include colour correction, colour enhancements, exposure correction, shadow and highlight recovery, and a little artistic flare. PHOTOS BY BRI does not provide any unedited or RAW images to CLIENTS. COPYRIGHTS: Australian Copyright Law states that the copyright of photographs remains with PHOTOS BY BRI. PHOTOS BY BRI grants the CLIENT permission to use the images in the following conditions. The images taken are for personal use by the CLIENT and may be shared on social networking websites, and with family and friends, in digital and print form. They may also be shared on vendor websites as long as the images remain unaltered and textual credit is explicitly given to PHOTOS BY BRI. Selling, publication or any commercial use of the photographs is not allowed without prior written permission from PHOTOS BY BRI. MODEL RELEASE: The CLIENT hereby grants PHOTOS BY BRI the irrevocable and unrestricted consent to use and publish photographs of the CLIENT for editorial, advertising, competition entry, educational and any other purpose and in any manner and medium; to alter the same without restriction. The CLIENT releases all claim to profits that may arise from use of images. LIMIT OF LIABILITY: In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, or other cause beyond the control of the photographer(s), the session will be rescheduled. In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond PHOTOS BY BRI’s control, including but not limited to camera, hard drive, or equipment malfunction, the PHOTOS BY BRI’s liability is limited to the return of all payments received for the session. The limit of liability for a partial loss of images is based on the percentage of total images supplied. Once the CLIENT has received the entirety of their package, the PHOTOS BY BRI is no longer liable for the loss of images. COMPLETION SCHEDULE: Images are expected to be edited and uploaded within 3 - 4 weeks post the session date. Under some circumstances this may be take longer. PAYMENT SCHEDULE: The aforementioned non-refundable booking fee is due on booking. The remaining balance of the amount agreed is payable in full before commencement of the session with proof of payment sent, unless signed payment plan is in place. In the event the CLIENT fails to remit payment as specified, PHOTOS BY BRI shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not complete the service.
