AGREEMENT FOR WEDDING PHOTOGRAPHY SERVICES *
AGREEMENT: This Agreement contains the understanding by and between Brianna Niebling T/A “Photos By Bri” hereinafter referred to as “the PHOTOGRAPHER(S)” and the Bride and Groom name (as listed above), hereinafter referred to as “The CLIENT” relating to their wedding day and additional requirements detailed, hereinafter referred to as “The EVENT(S)”. It supersedes all prior and simultaneous agreements between the parties. CONFIRMATION/ RESERVATION: A completed contract (wedding photography services agreement form) and 25% non-refundable deposit are required to reserve the date and time of the EVENT(S), and to confirm the stated wedding services from the PHOTOGRAPHER(S). If the EVENT(S) are rescheduled, postponed, or cancelled for whatever reason, or if there is a breach of contract by the CLIENT, the deposit is non-refundable and will be considered as liquidated damages to the PHOTOGRAPHER(S). In the case the EVENT(S) are rescheduled or postponed, the PHOTOGRAPHER(S) will do their best to accommodate, but there is no guarantee they will be available. SERVICE INCLUSIONS: The PHOTOGRAPHER(S)'S service includes a pre-wedding consultation and photographic coverage on the day of your wedding. The final product is all of the best photos from the day, hand-picked by the PHOTOGRAPHER(S). The final images are each individually, professionally edited, and received by USB or online gallery download as high resolution jpeg files. COMPLETION SCHEDULE: Images will be edited within 8 weeks of the wedding date. USB delivery or gallery upload is expected within this time frame, but may take longer under rare circumstances. The CLIENT will be notified if the schedule changes. EVENT SCHEDULE: The CLIENT agrees to confirm the schedule one week prior to the EVENT(S). Notification of any changes in schedule or location must be made in a timely manner. Shooting commences at the scheduled start time and ends at the scheduled end time. If the CLIENT does not arrive at the appointed time for the EVENT(S), shooting will commence at the scheduled start time and end at the scheduled end time. All additional time beyond the scheduled end time will be billed to the CLIENT. The shooting schedule is designed to utilize the locations and daylight to absolute maximum. The CLIENT and the PHOTOGRAPHER(S) therefore agree that punctuality and cooperation are essential to accomplish the goals of all parties. In cases where the wedding does not run on time, the PHOTOGRAPHER(S) cannot guarantee there will be enough time to get the desired set of photos although in such circumstances they will do their best to fulfil the CLIENT’s wishes with the time that is left. COOPERATION: The CLIENT and the PHOTOGRAPHER(S) consent to happily cooperate and communicate with each other to achieve the best possible result within the understanding of this contract. The PHOTOGRAPHER(S) may require the assistance of the best man or a friend to point out key individuals, as well as help organising family groups. The CLIENT agree to give the PHOTOGRAPHER(S) sufficient warning of key events at the wedding to give them time to prepare e.g. Bouquet throwing, cutting the cake, speeches, first dance, etc. Please note that not all guests at the wedding will like having their photo taken. In such cases the PHOTOGRAPHER(S) will use their discretion but cannot be held responsible for a lack of photos of these people. The CLIENT agree to give the PHOTOGRAPHER(S) precedence over their guests in order to take the photographs required for the wedding services agreed upon. The PHOTOGRAPHER(S) cannot be held liable for a lack of wedding photos if guests taking their own photos of the CLIENT continually interrupt the PHOTOGRAPHER(S)’s work. RESPONSIBILITIES: The PHOTOGRAPHER(S) is not responsible for compromised coverage due to causes beyond the control of the PHOTOGRAPHER(S) including but not limited to weather conditions, schedule complications, restrictions of the locations, obtrusive guests, lateness of the CLIENT or guests, or incorrect addresses provided to the PHOTOGRAPHER(S). The PHOTOGRAPHER(S) is not responsible for backgrounds or lighting conditions which may negatively impact or restrict the photos. The PHOTOGRAPHER(S) is not held liable for missed coverage of any part of the EVENT(S), and will not be held accountable for failure to deliver images of any individuals or any objects at the EVENT(S). The CLIENT agrees to provide the PHOTOGRAPHER(S) with a meal if the PHOTOGRAPHER(S) are working through the reception. This does not apply if the PHOTOGRAPHER(S) is working less than 6 hours. VENUE AND LOCATION LIMITATIONS: The PHOTOGRAPHER(S) is sometimes limited by rules and guidelines imposed by registrars, ministers, and venue management. In such circumstances the CLIENT agree to accept the technical results of their imposition on the equipment used. The CLIENT are advised to make themselves aware of the rules of the venue concerned. If necessary, negotiation with the officials for moderation of guidelines is the CLIENT’s responsibility; the PHOTOGRAPHER(S) will offer technical recommendations only. PERMITS: The CLIENT is responsible for acquiring all permits and necessary permission for all locations on which the PHOTOGRAPHER(S) will be performing services. SAFETY: The PHOTOGRAPHER(S) reserves the right to terminate coverage and leave the location of the EVENT(S) if the PHOTOGRAPHER(S) experiences inappropriate, threatening, hostile or offensive behaviour from person(s) at the EVENT(S); or in the event that the safety of the PHOTOGRAPHER(S) is in question. POST PRODUCTION AND EDITING: The final post production and editing styles, effects, and overall look of the images are left to the discretion of the PHOTOGRAPHER(S). The PHOTOGRAPHER(S)'S edited images include colour correction, colour enhancements, exposure correction, shadow and highlight recovery, and a little artistic flare. The PHOTOGRAPHER(S) does not provide any unedited or RAW images to the CLIENT. COPYRIGHTS: Australian Copyright Law states that the copyright of photographs remains with the PHOTOGRAPHER(S). The PHOTOGRAPHER(S) grant the CLIENT permission to use the images in the following conditions. The images taken are for personal use by the CLIENT and may be shared on social networking websites, and with family and friends, in digital and print form. They may also be shared on vendor websites as long as the images remain unaltered and textual credit is explicitly given to the PHOTOGRAPHER(S). Selling, publication or any commercial use of the photographs is not allowed without prior written permission from the PHOTOGRAPHER(S). MODEL RELEASE: The CLIENT hereby grants the PHOTOGRAPHER(S) the irrevocable and unrestricted consent to use and publish photographs of the CLIENT for editorial, advertising, competition entry, educational and any other purpose and in any manner and medium; to alter the same without restriction. The CLIENT releases all claim to profits that may arise from use of images. LIMIT OF LIABILITY: In the unlikely event that the assigned photographer is unable to perform to the guidelines of this contract due to an injury, illness, or other cause beyond the control of the PHOTOGRAPHER(S), every effort will be made to secure a replacement. If a second-shooter is booked, they will assume the role of main shooter. If the second-shooter is unavailable for the reasons above, every effort will be made to secure a replacement. If both photographers are unavailable and a suitable replacement is not found, responsibility and liability is limited to the refund of all payments received for the EVENT(S). In the unlikely event that digital files have been lost, stolen, or destroyed for reasons beyond the PHOTOGRAPHER(S)’S control, including but not limited to camera, hard drive, or equipment malfunction, the PHOTOGRAPHER(S) liability is limited to the return of all payments received for the EVENT(S). The limit of liability for a partial loss of images is based on the percentage of total images supplied. Once the CLIENT has received the entirety of their package, the PHOTOGRAPHER(S) is no longer liable for the loss of images. PAYMENT SCHEDULE: The aforementioned 25% non-refundable deposit is due on accepting this agreement. The remaining balance of the amount agreed is payable in full no later than 7 days before the wedding, unless payment plan has been agreed upon. In the event the CLIENT fails to remit payment as specified, the PHOTOGRAPHER(S) shall have the right to immediately terminate this agreement with no further obligation, retain any monies already paid, and not attend the EVENT(S).
